Terms of Service

Agreement to terms

By accessing or using WhereNow, including the website (wherenow.ca) and the WhereNow mobile application, you agree to be bound by these Terms of Service. WhereNow is based in Nova Scotia, Canada. If you do not agree to these terms, do not use the platform.

Description of service

WhereNow is a live event discovery platform that allows users to browse and discover local events. Users can browse events without creating an account. Event organizers may submit events for review and publication on the platform. The service is provided free of charge.

Eligibility

You must be at least 13 years old to use WhereNow. By using the platform, you represent that you meet this requirement.

Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent event information
  • Use the platform for spam, advertising unrelated to events, or solicitation
  • Attempt to circumvent security measures, CAPTCHA, or access controls
  • Interfere with the operation of the platform
  • Scrape, crawl, or harvest data from the platform by automated means without permission
  • Use the platform for any unlawful purpose
  • Impersonate any person or entity
  • Upload content that is harmful, offensive, or violates the rights of others

Event submissions

Events submitted through the platform are subject to review and moderation. WhereNow reserves the right to reject, edit, or remove any submission at its sole discretion, without notice or explanation.

Submitters are responsible for the accuracy and legality of their submissions. By submitting an event, you grant WhereNow a non-exclusive, royalty-free license to display, distribute, and promote the event information on the platform. Uploaded event images are stored and publicly displayed alongside the event listing.

Content and intellectual property

The WhereNow name, logo, design, and original content are the property of WhereNow. Event information displayed on the platform is provided by event organizers and third parties. WhereNow does not claim ownership of user-submitted content but retains the license granted in the event submissions section above.

Events listed on WhereNow may contain links to third-party websites. WhereNow does not control and is not responsible for the content, accuracy, or practices of any external sites. Accessing third-party links is at your own risk.

Disclaimers and limitation of liability

The platform is provided “as is” and “as available” without warranties of any kind, express or implied. WhereNow does not guarantee the availability, uninterrupted operation, or error-free performance of the platform.

WhereNow displays event information but is not the event organizer. WhereNow does not endorse or guarantee any event, organizer, or listing on the platform.

Users attend events entirely at their own risk and must exercise their own judgment and due diligence regarding any event discovered through the platform.

WhereNow is not responsible or liable for anything that occurs at, during, before, or after any event listed on the platform, including but not limited to personal injury, property damage, cancellations, changes, misrepresentation, or any other loss or harm of any kind.

To the maximum extent permitted by law, WhereNow shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or your reliance on any information provided through it.

Termination

WhereNow may restrict or terminate access to the platform at any time, for any reason, without notice. Provisions of these terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, and governing law.

Privacy

Your use of the platform is also governed by our Privacy Policy.

Governing law

These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Nova Scotia.

Changes to these terms

WhereNow may update these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.

Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
